Schumer Erupts On Supreme Court Justice

( – On Tuesday, Senate Majority Leader Chuck Schumer (D-NY) slammed Chief Justice John Roberts for not taking more action to ensure the ethics of other justices or making any effort to grant the Democratic requests to deal with forum shopping in the lower courts.  

In his statement, Schumer argued that Robert had, in his opinion, failed in his responsibility as the chief justice to ensure that the court remains fair. He added that one of the issues that the justice had fallen short on was an issue that he cared for which is forum shopping. However, he pointed out that this was not where Roberts’s failings end as he has also fallen short on “ethics and recusal.” 

Schumer in his announcement noted that the Judiciary Committee, its chair Dick Durbin (D-IL), and himself were looking at the best action plan for them to move forward. 

Last month, Durbin told The Hill that the Senate would be holding a vote on Supreme Court ethics legislation within the year. This was after the recent reports by The New York Times that conservative Justice Samuel Alito had displayed an “Appeal to Heaven” flag and an upside-down American flag. These two flags are commonly associated with being connected to the Jan. 6th Capitol attack. 

He argued that this was a “must” and that they needed to ensure that there were ethical standards established, as well as a recusal standard put in place. 

The Supreme Court Ethics, Recusal, and Transparency Act have been sponsored by Sen. Sheldon Whitehouse (D-RI) and Durbin. The Act specifically calls for the Supreme Court to adopt a code of conduct and put in place mechanisms for the investigation of any violations of the laws and code of conduct.
