( – Legal scholar and conservative commentator Jonathan Turley has claimed that the House Republicans do not have sufficient evidence to bring forward impeachment proceedings against Homeland Security Secretary Alejandro Mayorkas.

In an op-ed in The Daily Beast, Turley pointed out that the impeachment proceedings that the GOP is aiming to bring forward are on the grounds of policy disagreement. He added that there was insufficient evidence to support having Mayorkas removed from office.

Turley wrote in his op-ed that there is no available evidence right now which suggests that Mayorkas was involved in an impeachable offense. He further cited the 1870s impeachment of one Cabinet secretary who had been accused of taking kickbacks.

Turley continued that while Mayorkas could be accused of having enabled the open border policy, this would fall under the grounds of disagreement of policy. He added that the policy itself can be traced back to the President. As he noted while he believed that Biden had been completely wrong on immigration, voters would soon be given the option to vote on these policies during the presidential election. All Mayorkas had done was carry out the policies, which is not conduct that can be considered “criminal or impeachable.”

Cabinet secretaries can only face impeachment for high crimes and misdemeanors.
Turley, who has often been a Republican witness during congressional proceedings, has previously also made comments about the lack of evidence in the impeachment inquiry and investigations that have been launched against President Biden and his family. As he has said he does not believe that the current evidence supports the introduction of impeachment articles.
