
(PatriotNewsDaily.com) – New Mexico U.S. District Judge David Urias has temporarily blocked the health order that would ban both open and concealed carry in the state. The order was signed by New Mexico Gov. Michelle Lujan Grisham’s (D) less than a week earlier.
Grisham issued the emergency health order late last week to address the increase in violent crimes within the state. The restrictions would apply to all public places, with the only ones exempt from following the rule being security personnel and police officers who have a license to carry. The order was going to expire in 30 days and would only be enforced in areas that meet a certain violent crime threshold, which was currently only met by Albuquerque.
As the reason for the order, the governor pointed out that there were several fatal shootings of children in the state in the past few months. The order was heavily criticized and many lawsuits were filed against the order, claiming that it was a violation of the Second Amendment rights that the state’s residents should be granted.
Urias sided with the plaintiffs in many of these cases and suspended the order until the October 3rd court hearing. He pointed out that he did not blame the governor for wanting to do something to combat these “terrible acts,” he was specifically asked to address the questions relating to the rights of citizens.
Local police have also opposed the rule with the local county sheriff and the Albuquerque Police Department stating that they would not be enforcing it.
