(PatriotNewsDaily.com) – On Sunday afternoon, during an appearance on MSNBC with host Jen Psaki, former Acting Solicitor General Neal Katyal argued that while the decision in Colorado allowed former President Donald Trump to remain on the ballot, the ruling could still have “devastating” effects for Trump. As she pointed out this is because Trump was found in the ruling to have engaged in insurrection against the U.S. government following the 2020 presidential election.
As he pointed out, this was a judge factually finding that Trump had engaged in insurrection. As she pointed out, especially in appeals, factual findings can play a big role, which is why District Judge Sarah B. Wallace’s ruling could play an important role in the appeals court. She added that the factual findings are also “almost impossible to overturn” which is particularly important for Trump.
Katyal added that as an appeals lawyer if he were to characterize the Friday deadline she would argue that this is the best possible decision that the trial court could have reached regarding Trump. As she pointed out this case is likely going to go to the Colorado Supreme Court for an appeal and maybe even the country’s Supreme Court, where Trump was likely to face a lot of “headwinds” because of it.
Had Trump been removed from the 2024 Colorado battle it could potentially have completely eliminated his chances of winning in the 2024 presidential election. Previously Biden had won in Colorado by 55 percent compared to Trump’s 41 percent in 2020. However, in recent months Trump appears to have become more popular in the state.
