Judge Chutkan Sways Supreme Court Against Trump

(PatriotNewsDaily.com) – U.S. District Court Judge Tanya Chutkan has issued a significant ruling against Donald Trump that appears to be strategically aimed at the Supreme Court, as observed by former U.S. Attorney Joyce Vance.

Trump is currently involved in multiple criminal cases, with a notable federal election interference case overseen by Chutkan. This case, set to begin in March 2024, focuses on Trump’s alleged efforts to disrupt the 2020 presidential election results, leading to the Capitol riot on January 6th, 2021. Trump has maintained his innocence, pleading not guilty to charges including conspiracy to defraud the U.S. government and obstructing an official proceeding, as well as in the other three criminal cases he faces.

Chutkan’s recent ruling asserts that Trump’s position as a former president does not grant him immunity from prosecution for alleged criminal acts committed while in office. This decision counters the argument of Trump’s legal team, which claimed presidential immunity.

Joyce Vance, a former U.S. Attorney, commented on MSNBC about the strategic nature of Chutkan’s ruling. Vance suggested that Chutkan is crafting an argument tailored for the Supreme Court, emphasizing the balance between the separation of powers and the functioning of government branches. This approach, Vance noted, aligns with the Supreme Court’s recent focus on historical context and founding principles.

The appeal of Chutkan’s decision, if pursued, is expected to reach the Supreme Court, where Trump’s legal team might see a potential advantage due to the current conservative majority, which includes three justices appointed by Trump.

However, legal experts like Dave Aronberg, State Attorney for Palm Beach County, Florida, believe Chutkan’s well-reasoned decision should withstand appellate scrutiny. Aronberg highlighted that the ruling aligns with the principle that no one, including a president, is above the law. He also noted Chutkan’s intention to expedite Trump’s trial before the 2024 election, a plan that could be impacted by the Supreme Court.

Trump’s camp has criticized the legal proceedings, with his spokesman Steven Cheung claiming that the actions of the “radical Democrats” and President Joe Biden are an attempt to undermine constitutional principles and interfere with the 2024 Presidential Election.
