Even in a process that has been riddled with secrecy, unprecedented levels of partisan vitriol, departures from long-established norms, and a stunning absence of evidence, Democrats managed to outdo themselves following their vote to impeach President Donald Trump. Only minutes after the vote, House Speaker Nancy Pelosi slyly indicated that they might just “sit” on the impeachment articles until they could be guaranteed a “fair trial” in the Senate. Yes, after running one of the most astoundingly partisan inquiries in U.S. history, Pelosi is irate that impeachment is about to get the same treatment across the Capitol.
The next day, she made it official: the House of Representatives would adjourn until January 7, leaving the articles of impeachment in limbo until after the new year.
Hilariously, even legal experts who have been pushing for impeachment are now scratching their heads and wondering if Democrats have gone completely off the rails. In an op-ed for Bloomberg, Noah Feldman, a Harvard lawyer who actually testified on behalf of the Democrats just last week, wrote that until Pelosi sends the impeachment to trial, President Trump has justification to claim that…he wasn’t actually impeached!
“An indefinite delay would pose a serious problem. Impeachment as contemplated by the Constitution does not consist merely of the vote by the House, but of the process of sending the articles to the Senate for trial. Both parts are necessary to make an impeachment under the Constitution: The House must actually send the articles and send managers to the Senate to prosecute the impeachment. And the Senate must actually hold a trial,” Feldman wrote.
“If the House does not communicate its impeachment to the Senate, it hasn’t actually impeached the president,” he continued. “If the articles are not transmitted, Trump could legitimately say that he wasn’t truly impeached at all.”
It is increasingly clear that the supposedly-brilliant Nancy Pelosi actually has no idea what she’s doing at all. After bringing an impeachment against Trump that enumerated no crimes (because, yuk yuk, impeachment is a “political process”), she’s now insisting that Mitch McConnell must recuse because he isn’t meeting the legal standards for impartiality. And of course, the media is all too happy to parrot this bizarre logic; whatever it takes to “get Trump” and make Republicans look like the bad guys.
It’s at times like these where you just have to have faith that most Americans (or at least enough Americans) are smart enough to see what’s really going on here. The polls so far indicate that this is the case, but we’ll see.
