Rep. Alexandria Ocasio-Cortez (D-NY), called on the Biden administration to ignore U.S. District Judge Matthew J. Kacsmaryk’s order which led to an injunction against the Food and Drug Administration’s approval of mifepristone, an abortion pill that has been used for over two decades.
On Friday the Trump-appointed judge ruled that the FDA needed to halt its approval of mifepristone as a result of a lawsuit that questions the drug’s safety and process of approval. In his statement, Kacsmaryk paused the approval of the abortion pill, while also allowing the Biden administration a seven-day period in which they could appeal the decision as well as “seek emergency relief.”
The Biden administration was quick to announce that they were going to be appealing the court’s ruling. Democrats have been widely outraged by the court’s decision, with two lawmakers, including Ocasio-Cortez calling on President Biden to not enforce the injunction while the lawsuit is still in court.
In a statement on CNN, she claimed that the administration needed to “ignore this ruling.” She further added that the “deeply partisan” judges have “engaged in unprecedented and dramatic erosion of the legitimacy of the courts,” and even stated that this ruling was unprecedented and “unfounded.” She continued to say that this ruling entirely depends on someone else enforcing the halt, so the Biden administration could choose whether or not they will enforce it.
Sen. Ron Wyden of Oregon made a similar statement claiming that this decision was based on conservatives’ ideology and that the FDA should have the right to ignore this ruling.
